1. About us
These Terms govern use of pathsuremedical.co.uk and our services. We are PathSure Group Ltd. (company no. [number]), registered at [address]. Contact: [email protected] · 020 1234 5678 · Mon–Fri 08:00–18:00.By requesting a quote or using our services, you agree to these Terms.
2. Services
We provide healthcare logistics — private clinic logistics, dental laboratory transport, scheduled healthcare routes and urgent medical deliveries — in line with UK regulations, including UN3373 where applicable.
3. Quotes and bookings
Quotes are valid for 30 days and are not binding offers. A contract is formed when we confirm a booking in writing. You must give us accurate collection, delivery and consignment details.
4. Your responsibilities
You must:
package, label and document items in line with applicable law;
declare hazardous, temperature-sensitive or infectious items in advance;
have someone available at collection and delivery;
hold all required licences and comply with data protection law.
5. Items we will not carry
Category A infectious substances, controlled drugs without Home Office authorisation, cash and high-value items, live animals (unless agreed), and anything prohibited by law or our insurers. We may refuse or return non-compliant consignments at your cost.
6. Fees and payment
Fees are as per your quote, exclusive of VAT. Invoices are payable within 30 days. Late payments accrue interest under the Late Payment of Commercial Debts (Interest) Act 1998. We may suspend services for unpaid invoices.
7. Cancellations
Scheduled bookings may be cancelled with reasonable notice. Urgent deliveries cancelled after dispatch may incur the full fee. We may cancel bookings that are unsafe or non-compliant.
8. Delivery times
We use reasonable care and skill. Unless we expressly guarantee a time slot in writing, times are estimates and time is not of the essence. We are not liable for delays beyond our reasonable control.
9. Liability
We do not exclude liability for death, personal injury caused by our negligence, fraud, or anything that cannot be limited by law.Subject to that, our total liability for any claim is capped at the greater of: (a) fees paid in the 3 months before the event; or (b) the limit recoverable under our insurance. We are not liable for indirect or consequential loss, loss of profit, business or data.Claims must be notified in writing within 7 days of delivery or expected delivery.
10. Insurance
We hold goods-in-transit, public liability and employers' liability insurance. Cover details on request. You are responsible for insuring items above our standard cover.
11. Force majeure
Neither party is liable for failures caused by events beyond reasonable control (e.g. severe weather, industrial action, government action, pandemic, utility or network failure).
12. Confidentiality and data
Each party will keep the other's confidential information confidential. Where we process personal data on your behalf, we comply with the UK GDPR and Data Protection Act 2018. See our Privacy Policy.
13. Intellectual property
The Website and the PathSure name and logo are owned by or licensed to us. No copying or reuse without our written consent, except normal browsing.
14. Termination
Either party may terminate for material breach not remedied within 30 days, or on insolvency. Accrued rights survive termination.
15. Changes
We may update these Terms. Material changes will be notified to active clients.
16. Governing law
English law applies. The courts of England and Wales have exclusive jurisdiction.
